Terms and Conditions: Local Market Insight Service
Eligibility of Service
This service is only available to organisations who are NPA Members (including Affiliates) who have pharmacies based in Scotland, Wales or Northern Ireland only and whom currently provide NHS services or have an NHS contract. Application for Local Market Insight reports is made on the NPA website at http://www.npa.co.uk/LocalMarketReport by using head office/main pharmacy member number and postcode details.
If you leave NPA membership, subscription your Local Market Insight service will be suspended and you will receive no refunds.
Delivery and Payment
Reports are emailed to the email address specified in the subscription around the first week of every month. You will receive the first report of your subscription the following month your order has been being processed which you receive notification by email confirmation. Payment for the Local Market Insight service is made by settling the invoice generated from your NPA sales account, standard NPA payment terms apply. The NPA reserves the right to amend prices at any time payable for Local Market Insight service.
Reports will be sent from LMR@npa.co.uk, please add this email address to your safe senders list.
Cancellation and Refunds or Amendments
This is an annual subscription, cancellations or refunds cannot be processed once the first report is delivered. Failure to pay for the Local Market Insight service may lead to your Sales account being placed on stop until payment is made.
You must inform us if your contractor code gets updated or you need to make changes to the email addresses of the recipients of the reports. To do so, please contact LMR@npa.co.uk detailing your member number and company name. If not, the NPA and Real World Analytics cannot be held liable for any missed reports
We reserve the right to cancel the subscription if at any time you breach terms of use. These terms include but are not limited to the reselling, repackaging of the reports, material gain or unauthorised third party usage.
Termination of subscription
We may terminate your subscription immediately if you are in breach of any of these terms and conditions or in the event that you leave NPA membership.
Term of Agreement
This agreement is valid for 1 year that will automatically renew. The account manager will receive a renewal notification prior to this. Notice not to renew the subscription must be given prior to 30 days of the renewal date. If no such notice is received the annual subscription renews automatically, invoice will be generated and the payment will become due.
Intellectual Property
All Intellectual Property contained in Local Market Insight remains the property of Real World Analytics and NPA and the customer shall not acquire any right or interest in such Intellectual Property and shall not use same save to the extent strictly required for the provision of the Services. Any enhancements added to the service during the agreement shall also remain the sole property of Real World Analytics and the NPA. Please also refer to Section 12 of the NPA Sales terms and conditions.
Liability
You will be liable to us for damage or loss we suffer due to any unauthorised or unlawful use of our site by you or any unauthorised use of any means of secured access we provide you with or any breach of these terms and conditions of use by you.
Real World Analytics and NPA have used reasonable endeavour to ensure the data held in Local Insight Market reports is accurate. We exclude all liability for all direct and consequential losses arising from the use of the reports.These terms and conditions do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, for fraud or for any matter which it would be illegal for us to exclude or to attempt to exclude our liability.
Force Majeure
We will not be liable for any delay in performing and/or failure to deliver the reports as a result of any circumstance beyond our reasonable control.
Data Protection Statement and General Data Protection Regulation
We, being the NPA Group of companies, will hold and process all personal information in accordance with the Data Protection Act 1998 and the General Data Protection Regulation.
By submitting your Information, which may include sensitive personal information to us, you consent to your Information being processed by us in accordance with this data statement for the provision of the products and services you receive/purchase from us including:
- managing the business processes required for the products and services which may include using third parties
- use your information for statistical analysis to analyse your use of our products and services including our website and related services using, for example, “cookies” when you access those services
- transfer our business assets or our rights under any Group product on sale or merger of the whole or part of the NPA Group. We may do this without contacting you
- transfer our information as required to obtain legal advice, comply with legal and regulatory requirements, protect our rights and property, and the safety of our employees, clients, suppliers and others. If we transfer the information outside the UK we will ensure the recipient continues to comply with the regulatory requirements
- where applicable to allow you to access to facilities such as NPA information, NPA training courses, NPA products and services and NPA insurance
- we will keep your data for as long as you are a customer and afterwards to meet our legal and regulatory obligations
If your information changes please inform us of the change so that we can update our records.
We would like to use this information to contact you at various times by post, telephone, electronically and by other means for the following purposes to promote products, services and competition which may be of interest to you, your business or your customers which you have selected your preferences in the registration form.
You may, at any time, notify us of any changes to the preferences you have made by contacting us.
You should show this data protection statement to anyone whose personal information you have submitted to us. You have the right to request copies of the Information we hold about you. If you would like to know what information we hold about you, contact the Head of Compliance, NPA, Mallinson House, 38-42 St Peter’s Street, St Albans, AL1 3NP. A fee may be charged for this. If you want to make a complaint about our data processing you can do so in writing to the above address.
At any time you may ask for further explanation of this policy or change the preference you have registered with us in terms of receiving communication from us or from Other Companies.
